TERMS AND CONDITIONS

for LAB SERIES 2023-2024 Loyalty Program

These Terms and Conditions govern the LAB SERIES LAB SERIES 2023-2024 Loyalty Program (hereinafter called “Program”) operated by or on behalf of LAB SERIES and our relationship with members of the Program (hereinafter called “Member”, “Members” or “You”). Membership in the Program is subject to these Terms and Conditions, which are the only terms and conditions that apply to the Program. By agreeing to join the Program, you agree that:

(a) you have read, understood and accepted these Terms and Conditions;

(b) you are eligible for membership;

1. MEMBERSHIP

1.1 After satisfying the Program entry criteria as determined at the sole discretion of LAB SERIES, you will be invited to become a Member of the Program. The membership period is based on a fixed term for all Members and will be reviewed and renewed for the next term once renewal criteria are reached. Once you successfully join the Program, you will attain a Program membership with either your current LAB SERIES VIP number or a new number assigned by LAB SERIES. You will also receive details of the Program.

1.2 Membership is complimentary and is available only to individuals, not to companies, partnerships, associations, groups or other entities. You may not have more than one membership or any form of joint membership. LAB SERIES may refuse membership without giving any reason.

1.3 Enrolment to the Program is on an individual basis and is open to individuals aged 18 or above.

1.4 Membership in the Program is not transferable and may only be used by the registered member. Membership numbers remain the property of LAB SERIES and may be changed at any time or cancelled upon termination of the Program.

1.5 Unless otherwise stated, member benefits under the Program are subject to availability.

1.6 You may cancel your membership at any time with written notification and surrender your membership number. Upon receipt of your cancellation request, all membership entitlements will be forgone and cancelled. You may choose to remain in the LAB SERIES database to continue receiving LAB SERIES news and promotions other than those related to membership in the Program.

1.7 LAB SERIES reserves the right to suspend, discontinue, or terminate the membership of any Member who is found to be using the Program in a manner inconsistent with the Terms and Conditions, or the intent of the Program or any portion of the Program. LAB SERIES also reserves the right to discontinue membership of any Member who acts in a manner inconsistent with the spirit of the Program. Discontinued membership will result in the loss of all present and future benefits and privileges.

1.8 LAB SERIES reserves the right to terminate the Program at any time.

1.9 LAB SERIES reserves the right to add, modify, delete or otherwise change any of the terms, conditions, benefits and services pertaining to the Program at its sole discretion, at any time without prior notice to the Members.

1.10 LAB SERIES’s interpretations of the Program’s Terms and Conditions shall be binding on the Members for all purposes and to all intents.

2. POINTS REDEMPTION

2.1 Members are entitled to accrue The Program’s Bonus Points (hereinafter called “Points”) for Hong Kong dollars spent at the [ANY DESIGNATED COUNTERS / CONCEPT STORES] and LAB SERIES [COUNTERS / CONCEPT STORES] at [ANY DESIGNATED LOCATIONS] (hereinafter called “Designated LAB SERIES Counters”) from 1st July, 2023 – 30th June, 2024 in the manner set out under Clause 2.2 below or for participation in special promotions as determined by LAB SERIES.

2.2 Members are entitled to accrue 1 Points for every $1 Hong Kong dollars spent at LAB SERIES counters at Hong Kong and Macau, IF APPLICABLE, or from LAB SERIES website https://labseries-buys.hk.

2.3 The Points are valid from 1st July, 2023 – 30th June, 2024 for all Members and will expire and be forfeited after the period of validity.

2.4 The Points are not transferrable.

2.5 The Points are not exchangeable for cash, nor can they be used as cash. They can only be used for the redemption of the products / benefits / services listed in the LAB SERIES 2023-2024 Loyalty Program Rewards Brochure.

2.6 The list of products / benefits / services that may be redeemed using Points may be changed from time to time.

2.7 Redeemed products / benefits / services are not refundable, nor can they be exchanged. The products / benefits / services redeemed under the Program are for personal use only. Members may not sell or resell any such products / benefits / services. Violation of this term may result in the termination of membership.

2.8 Members shall make redemptions only at the Designated LAB SERIES Counters in person using the Points accrued in his / her Membership account during redemption periods occurring on a quarterly basis as notified by LAB SERIES or during seasonal promotions as otherwise designated by LAB SERIES. Balance of unused Points will be carried forward until the Points expire.

2.9 LAB SERIES is not responsible for lost, damaged, or stolen products or vouchers redeemed. Suspected illegal, fraudulent or other unauthorized use of LAB SERIES issued products / benefits / services or any other activity inconsistent with these Terms and Conditions shall result in the termination of membership. LAB SERIES reserves the right to audit membership accounts at any time.

2.10 The Points accrued from any purchased products that are returned or refunded by Member will be foregone and cancelled. The Member shall without limitation be liable to LAB SERIES for the full price of the products / benefits / services redeemed from such cancelled points.

2.11 Points may take up to 1-2 weeks after the Member’s purchase or participation in special promotions to be credited to the Member’s account. Points are valid for the redemption of products / benefits / services as soon as they are credited to the Member’s account.

2.12 Gifts are in limited supply. Handling time may take up to 1 week. A substitute will apply if a gift is out of stock without further notice.

2.13 Members are entitled to extra Points for the first purchase during his / her birthday month. Members who make any purchase will be entitled to enjoy additional 500 Points in addition to the Points earned from the purchase of the product. The birthday offer can be enjoyed once a year only.

2.14 For those rewards that are manufactured or provided by third parties, LAB SERIES excludes all liability in respect of their quality. In particular, LAB SERIES does not warrant that any reward from third parties will be provide with reasonable care and skill.

2.15 Members should immediately report any suspected unauthorized redemption claims. LAB SERIES will decide at its discretion what action, if any, will be taken. LAB SERIES may refuse to credit Points to a Member’s account to compensate for any unauthorized redemption should the Member in any way contribute to the unauthorized redemption by negligence or otherwise. The sale or barter of Points and products / benefits / services redeemable is prohibited and will result in the forfeiture of all Points or rewards and the cancellation of membership. Violators will be liable for damages suffered or incurred by LAB SERIES.

2.16 If there is any dispute between a Member and LAB SERIES in relation to the Program’s Points redemption, the records kept in the Program system of LAB SERIES shall be deemed as the conclusive evidence and the decision of LAB SERIES shall be final.

3. DATA PRIVACY

3.1 LAB SERIES intends to use the personal data provide by Members (including name, birthday, mobile or telephone number, email or residential or correspondence address) for the operation of the Program, delivery of associated benefits and services, Program development, direct marketing relating to the Program and its associated benefits and services, as well as direct marketing relating to skin care cosmetics, beauty and accessory products and services, or those of a similar nature offered by LAB SERIES and its affiliates, and to communicate news and information to Members for their benefit, and it intends to transfer such personal data to its affiliates, successors and business partners in other regions for the said purposes. LAB SERIES may not use or transfer Members’ personal data without their written consent and Members hereby expressly agree that their personal data is provided voluntarily, and it may be stored, transferred, used, processed or held by LAB SERIES and its affiliates, successors and business partners in other regions for the said purposes.

3.2 LAB SERIES collects personal data about our Members so that we can provide membership services. It is voluntary for Members to supply their personal data, but we may not be able to provide membership services, in full or in part, if Members do not supply any such data. LAB SERIES will not sell this information. Since the privacy of our Members is of paramount importance to LAB SERIES, we wish to protect it and maintain the trust of our Members while collecting the personal data necessary to do this. LAB SERIES is fully committed to providing information about the collection and use of personal data furnished by, or collected from, Members while using our websites, products and services. We offer Members the choice to decline (opt out) participation in certain services and promotional benefits provided by LAB SERIES and/or its carefully selected third parties. The full version of LAB SERIES’s Privacy Policy is available at https://www.labseries.com.hk/. Members consent that their personal data may be collected, used and transferred according to LAB SERIES’s Privacy Policy.

3.3 Members have the right to review, change or delete their personal data held by LAB SERIES. Please refer to LAB SERIES’s Privacy Policy on how to do so. Members’ contact details and profiles can be accessed and modified at any time by individual Members.

3.4 Members are responsible for keeping the Program up-to-date as to their correct communication/postal addresses.

Note: In the event of discrepancies between the English and Chinese versions of these Terms and Conditions, the English version shall apply and prevail.
